Overview

The State Code of Florida requires that all municipalities and counties within the state enforce the most current (5th edition, 2014, effective 06/30/15) Florida Building Code, including Building, Residential and Existing Building Codes, at a minimum. Sec. 21-326. – Oceanfront setbacks; Atlantic Ocean land.

(a) No person shall construct any structure whatsoever seaward of a line 50 feet landward of the crest of the existing dune line; make any excavation, remove any beach material, or otherwise alter existing ground elevations…

(b) In addition to the building setback line of 50 feet from the dune line, no building or structure shall be placed within 100 feet from the mean high-water mark of the Atlantic Ocean, and the greatest distance of the two measurement standards shall govern. The measurement of the setback line from the dune line and the high-water line shall be to the closest edge of any building or structure to be erected/constructed on the Atlantic oceanfront."
